The petitioner has been in custody since 19.02.2017 in connection with Harsidhi P.S. Case No. 366 of 2017 for the offence registered under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is no specific allegation against the present petitioner and the main allegation is against one Muni Sahni. It is further submitted that the petitioner has also got no criminal antecedent. Diary of the present case was called for which has since been received.

Leaned counsel for the State submits that save and except the fact that the petitioner was present at the place of occurrence, there is no further cogent material in the case diary to

Patna High Court Cr.Misc. No.8416 of 2018 (3) dt.06-03-2018 implicate the petitioner in connection with the present case. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran in connection with Harsidhi P.S. Case No. 366 of 2017.
