Petitioner, already in custody, seeks bail in connection with Motipur P.S. Case No.429 of 2017 registered under Sections 413/414 of the Indian Penal Code.
Allegation in brief is that police apprehended the petitioner with stolen motorcycle. It is also alleged against the petitioner that he is a member of the gang who disposes of the stolen motorcycle.
Learned counsel for the petitioner submits that recovery is not from possession of the petitioner, even the seizure list does not indicate that wherefrom the motorcycle was recovered, the petitioner has no criminal antecedent and he is in custody since 18.11.2017.

No.1479 of 2018(4) dt.13-04-2018 2/2 Having considered the aforesaid facts and circumstances, petitioner Raj Narayan Mahto is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, West, Muzaffarpur in connection with Motipur P.S. Case No.429 of 2017.
