Petitioner, already in custody, seeks bail in connection with Chapra Muffasil PS Case No.174 of 2017 registered under Section 392 of the Indian Penal Code.

Allegation in brief is that the petitioner along with another co-accused robbed the informant his gold chain, mobile and Rs.3000/-.

Learned counsel for the petitioner submits that the petitioner is a co-villager of the informant and has falsely been implicated in this case, moreover no incriminating article has been recovered from his possession, the petitioner has no criminal antecedent and he is in custody since 12.06.2017. Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.12292 of 2018(4) dt.18-04-2018 2/2 circumstances, petitioner Azad Alam is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saran in connection with Chapra Muffasil PS Case No.174 of 2017.
