The petitioner in the present case is seeking anticipatory bail in connection with Ara Nawada P.S. Case No. 231 of 2003 registered for the offences punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that nothing has been recovered from possession of the petitioner and there is no allegation of firing against him. Learned APP for the State has opposed the prayer of anticipatory bail by submitting that the petitioner has come before this Court 6 years after his prayer for anticipatory bail has been rejected by the learned Sessions Judge, Bhojpur at Ara. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.74730 of 2019(3) dt.29-11-2019 2/2 whereunder this petitioner is seeking anticipatory bail 16 years after the FIR was lodged against him and more than 6 years after his prayer for anticipatory bail was rejected by the learned Sessions Judge, Bhojpur at Ara, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The application is, thus, dismissed.
