Petitioner, already in custody, seeks bail in connection with Bakhtiyarpur Rail PS Case No.188 of 2017 registered under Section 379 of the Indian Penal Code.
Allegation in brief is that the petitioner snatched away the mobile of the co-passenger from the train and escaped away. Later on by CDR, it transpires that the SIM in the name of the petitioner was being used in the stolen mobile. Learned counsel for the petitioner submits that the mobile was not recovered from possession of the petitioner; whereas learned counsel for the State submits that two SIM numbers 9155718973 and 9572534789 in the name of this
Patna High Court Cr.Misc. No.12474 of 2018(3) dt.18-04-2018 2/2 petitioner was being used in the stolen mobile and the petitioner has similar kind of two antecedents.
Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Bakhtiyarpur Rail PS Case No.188 of 2017 pending in the court of learned Rail Judicial Magistrate, Patna. However, if the trial does not conclude within four months of the framing of the charge, the petitioner may renew his prayer of bail.
