JUSTICE ARUN KUMAR ORAL ORDER 14-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Alamganj PS Case No. 273 of 2016 registered under Sections 302 and 201 of the IPC.

Learned Counsel for the petitioner submits that the FIR is against unknown, there is no other material except confessional statement of one Md. Chand and two others, CDR of the mobiles of the petitioner and Md. Chand shows that they were talking on the day of the occurrence and even thereafter, petitioner is in custody since 24.2.2017.

Learned Counsel for the informant opposed the prayer for bail and submits that it is a case of circumstantial evidence and there is inculpatory statement made by the petitioner. Having considered the said facts and circumstances, the petitioner, namely, Farhana Jabi @ Farhan Jabi @ Farzana is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Patna City in connection with Alamganj PS Case No. 273 of 2016.

The petitioner is directed to appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause her bail bonds shall be liable to be cancelled.
