2. The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 386, 387/34 of the Indian Penal Code.
3. The allegation against the petitioner and other co-accused person is that they threatened the informant to vacate her house as the said house has already been purchased by one Nishit Bhaiya. It is
Patna High Court CR. MISC. No.67858 of 2023(2) dt.02-11-2023 2/3 further alleged that they also threatened shopkeeper Md. Abbas to vacate the shop.
4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Petitioner has no concern with the co-accused persons. It is further submitted that the house in question belongs to one Leela Sharma and the informant has nowhere related with the aforesaid house. Moreover, the petitioner is languishing in judicial custody since 18.08.2023.
5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Sitamarhi P.S. Case No. 652 of
