The petitioner has filed the instant application for grant of anticipatory bail apprehending his arrest in connection with Rail P.S. Patna Case No. 346 of 2016 registered for the offence under section 379 of the Indian Penal Code.

As per the allegation in the FIR, it is stated by the informant that when she got down from the train her bag containing laptop got left behind in the train and on search, the same was found missing. Hence, the FIR was registered against unknown.

It is submitted by learned counsel for the petitioner that he has been falsely implicated in this case only for the reason that he was working as coach attendant. He has not been put on T.I. Parade nor recovery of any incriminating article has taken place from his possession.

No.65846 of 2019(3) dt.26-11-2019 2/2 It is submitted by learned APP for the State that the case diary in the instant case had been called for and in paragraph 12 of the same the statement of the informant has been recorded wherein she categorically states that firstly she received information that her Laptop was with the petitioner and subsequently received the same. The said statement has been confirmed by Manish Kumar, the Bed Roll Supervisor in paragraph 13 of the case diary wherein he has stated that on earlier occasion the petitioner was not ready to return the Laptop but subsequently he returned the same.

Having heard learned counsel for the parties and taking into consideration the above stated facts, the Court is not inclined to enlarge the petitioner on bail and as such his application for anticipatory bail is rejected. However, the petitioner may surrender in the court below within six weeks. In case the petitioner surrenders within the aforesaid time the court below shall consider the application for bail without being prejudiced by this order of rejection.
