JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-10-2019 This application, for grant of anticipatory bail, arises out of Thawe P.S. Case No. 116 of 2019, disclosing offences under Section 30(a) of Bihar Prohibition and Excise Act. Allegation as per F.I.R. is that Scorpio vehicle of the petitioner was seized by the police and from the vehicle 161.280 litres of liquor has been recovered.
Submission of learned counsel for the petitioners is that at the time of alleged recovery, the petitioner was in lucknow for his treatment and he has given his vehicle to the driver and he has no knowledge about the same. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circusmtances, this application is allowed. Let the petitioner,
Patna High Court CR. MISC. No.62169 of 2019(2) dt.01-10-2019 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum-Special Judge, Gopalganj, in connection with Thawe P.S. Case No. 116 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure with further subject to the condition that he has to cooperate in investigation and appear before the police as and when required.
