The petitioner seeks bail in Thakraha (Bhitaha) P.S. Case No. 207 of 2017 registered under Section 379 & 411 of the Indian Penal Code.
Petitioner is said to have stolen the motorcycle of the informant and was apprehended with the same when he arrived in his village on the said motorcycle.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case due to ulterior motive as he happened to be a tractor driver of the informant but later on left his service and refused to render his

No.7417 of 2018 (02) dt.07-02-2018 2/ 2 service to the informant in spite of his request and when he had gone to the sister's house which is located in the informant's village, informant falsely implicated him in this case due to grudge. The occurrence is said to be of 22.07.2017 but the F.I.R. has been lodged after an abnormal delay on 07.10.2017 without assigning any plausible reason for the said delay. The petitioner has been languishing in custody since 07.10.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Bagaha, West Champaran in connection with Thakraha (Bhitaha) P.S. Case No.207 of 2017.
