JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This application, for grant of anticipatory bail, arises out of Bettiah Nagar P.S. Case No. 121/19, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act. Prosecution case is that police raided the hotel of the petitioner and in room no. 203, one person, namely, Sanjay Kumar was found consuming liquor and about 100 ML of liquor in the bottle of 180 ML was recovered.
Submission of learned counsel for the petitioner is that he has been made accused in this case only because, he happens to be owner of the hotel and he was not aware about the keeping of liquor by the customer. Further submission is that he has no criminal antecedent and is ready to abide by any condition imposed on him.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Bettiah, West Champaran, in connection with Bettiah Nagar P.S.
