2. The present petition has been preferred for the following relief/s:

(i) for commanding and directing the Respondent Nos.-4 (Circle Officer, Sanjhauli) No.-5 (Circle Officer, Dinara) to remove encroachment from the Public Land as described in paragraph nos.-4, 8 and 9, respectively, after initiating due legal proceeding against the encroachers;

(ii) for commanding and directing the respondent no.-3 (District Magistrate, Rohtas) to ensure the removal of encroachment from the subjected Public

(iii) for such other relief(s) for which the petitioner may be found entitled to in the facts and circumstances of the instant case..

3. The last affidavit of the Circle Officer, Dinara, Rohtas shows that Lalmuni Ram and others preferred Encroachment Case No 37/2022-23 on 01.07.2025.

4. in view of the fact that an appeal has been filed as recorded in the supplementary counter affidavit, the Collector, Rohtas is directed to dispose of the appeal at an earliest preferably within a period of three months, if still not disposed of.

5. It is made clear that if the appeal of the encroachers are rejected, the Circle Officer, Rohtas is duty bound to take immediate steps for the removal of the encroachment within a specified period failing the petitioner shall be free to file contempt petition.

6. With the aforesaid observation, the writ petition is disposed of.
