2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109, 103(1), 352 and 351(2) of the BNS.

3. As per the prosecution case, all the FIR named accused along with 60-70 unknown persons assaulted to husband of the informant, as a result of which, he died.

4. Learned counsel for the petitioner submits that there is no allegation of assault against his petitioner. He is only alleged to be member of unlawful assembly. Petitioner claims clean antecedent and is in custody since 19.06.2025. Chargesheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-1st Class, East Champaran, Motihari in connection with Banjariya P. S. Case No. 334 of 2025.
