The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 498A/34 of the Indian Penal Code and Section 4 of D.P. Act pending in the learned court below.
Earlier, the matter was referred to Mediation Centre, Patna High Court. But, it was failed.
In para-8 of the bail application, learned counsel for the petitioner submits that petitioner is ready to keep his wife with full dignity and respect and opposite party no.2 is also ready to live with the petitioner.
Considering the aforesaid facts and circumstances, let the petitioner, named above, in the event of his
Patna High Court CR. MISC. No.67590 of 2022(5) dt.19-06-2023 2/2 arrest/surrender before the learned court below within a period of six weeks from today, be released on provisional bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the learned Court below, where the case is pending/Successor court, in connection with Complaint Case No.838/2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
Opposite party no.2 is directed to appear before the learned Court below on 26.06.2023 and petitioner is also directed to take away his wife to his work place with him. If the opposite party no.2 is not ready to go with the petitioner, the provisional bail bond of the petitioner shall be confirmed by the learned Court below.
If the petitioner does not appear before the learned Court below on the specified date as above and take away his wife to his work place with him, the bail bond of petitioner shall not be confirmed.
