JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2019 This is an application for grant of anticipatory bail in connection with Darauli P. S. Case No. 33 of 2019, disclosing offences under Sections 304B and 120B of IPC. Petitioners happens to be the Bhashur and mediator in the marriage. Case is of dowry death.

Submission of the learned counsel for the petitioners is that they are residing at Mumbai, which will appear from Annexure 2 series and no specific allegation has been attributed against them and Annexure 5 disclosed that the deceased died due to heart attack and she was taken for treatment to the hospital.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.61511 of 2019(2) dt.26-09-2019 2/2 submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-III, Siwan, in connection with Darauli P. S. Case No. 33 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
