The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a) (d) and 37 (c)of the Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioner submits that 40 litres of Mahua wine was recovered from the house of the petitioner. There is no recovery from the conscious possession of the petitioner. It is further submitted that the petitioner has got no criminal antecedent and he is languishing in judicial custody since 18.07.2019.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of
