The petitioner seeks bail in Laheriasarai P.S. Case No. 495 of 2016 registered under Sections 302 and 304 (b)/34 of the Indian Penal Code.

As per the prosecution case, the petitioner along with other accused persons are said to have set ablaze the deceased by pouring kerosene oil by hatching conspiracy along with other accused persons over dowry demand.

It is submitted by learned counsel for the petitioner that the petitioner happens to be brother-in-law of the deceased and has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He is living separately from the deceased and has no concern with the affairs of the deceased or her husband.

Patna High Court Cr.Misc. No.1169 of 2018 (02) dt.10-01-2018 - 2 - The petitioner has been languishing in custody since 30.11.2017. Similarly situated co-accused persons, namely, Ganesh Panjiyar, Munni Devi and Sanju Panjiyar, who happens to be father-in-law, mother-in-law and another bother-in-law of the deceased, have been enlarged on bail by a co-ordinate bench of this court in Cr. Misc. No. 42931 of 2017 vide order dated 18.09.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No.495 of 2016.
