2. The petitioner seeks bail in connection with Muffasil P.S. Case No. 489 of 2023 registered for the offence punishable under Sections 341, 323, 324, 325, 307 and 379/34 of the Indian Penal Code and Sections 25(1-b) a, 26, 35 and 27 of the Arms Act.
3. As per the prosecution case, the petitioner and others are said to have assaulted the victim and gave stab wound.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to land dispute. There is a counter case also. The
Patna High Court CR. MISC. No.71448 of 2023(2) dt.07-11-2023 2/2 petitioner is in jail since 17.07.2023.
5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Muffasil P.S. Case No. 489 of 2023.
7. The petitioner will also mark attendance in Muffasil Police Station, East Chmapran on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
