1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Chanan P.S. Case No. 65 of 2024 dated 28.06.2024 registered under Sections 341, 323, 504, 447, 354-B, 379 / 34 of the I.P.C.

3. As per the first information report on 25.06.2024 in the night the petitioner- Shailesh Yadav @ Shailesh Kumar entered into the house of the informant and tried to outrage her modesty and took away a sum of Rs. 40,000/- from a box.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to dispute between the neighbours. The petitioner is living adjacent to the house of the informant and on the date of occurrence the petitioner was brutally assaulted by the informant's family members, the petitioner went for his treatment, in the

Patna High Court CR. MISC. No.71504 of 2024(2) dt.26-10-2024 2/2 meanwhile, the present case based upon false story has been lodged in order to put pressure upon the petitioner not to lodge F.I.R. against the informant's family members.

5. Regard being had to the submission made by the parties, taking into consideration the nature of allegation, the fact that both the parties are residing in the same locality and the petitioner has got no criminal antecedent, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of District and Sessions Judge, Lakhisarai in connection with Chanan P.S. Case No. 65 of 2024 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
