Learned counsel for the State has pointed out that final order has already been passed in confiscation proceeding. Learned counsel for the petitioner seeks permission to withdraw this application with liberty to challenge the aforesaid order in an appropriate jurisdiction by filing an appeal. Permission is granted.

However, if such an appeal is preferred within 30 days together with an application for condonation of delay, the
