2. The petitioner seeks bail in a case registered for the offence punishable under Sections 20(B)(ii)(B)/21 (b) of the NDPS Act.
3 . As per prosecution case , 387 liters cough syrup was recovered from the Alto Car of which petitioner is registered owner.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner has falsely been implicated in this case . No incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. The car of the petitioner was used in transporting the illicit liquor without his knowledge and consent.
Patna High Court CR. MISC. No.72353 of 2024(2) dt.19-12-2024 2/2 Petitioner is in custody since 21.05.2024 . Chargesheet has already been submitted.
5 . Learned A.P.P. for the State vehemently opposed the bail application .
6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge - cumSpecial Judge NDPS Supaul in connection with Kishanpur ( Supaul ) P. S. Case No. 264 of 2022 .
