The petitioner seeks bail in connection with Delha P.S. Case No. 271 of 2022 registered for the offences punishable under Sections 8(c) 21(b), 25 and 29 of the N.D.P.S. Act. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is in custody since 20.08.2022 and the allegation is of recovery of 37 gm of Ganja along with a mobile from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and even presuming what has been alleged is true without admitting for the purposes of bail, then the alleged recovery is only 37 gm of Ganja which is small quantity.

Patna High Court CR. MISC. No.67168 of 2022(2) dt.29-04-2023 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Delha P.S. Case No. 271 of 2022.

One of the bailors of the petitioner shall be his father Anil Kumar @ Anil Sinha.

Accordingly, the present bail application stands allowed.
