2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 414, 420, 406 of the Indian Penal Code.

3. As per prosecution case, the petitioner is alleged to have tried to withdraw money by exchanging the ATM card of the informant but he was caught on spot and handed over to the police. Thereafter, six different ATM cards were recovered from his possession.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case on the basis of suspicion. It is further submitted that two seizure lists have been prepared for

Patna High Court CR. MISC. No.69663 of 2023(2) dt.03-11-2023 2/2 one occurrence which shows falsification of the allegation. The petitioner has no concern with the alleged occurrence. It is further submitted that the petitioner is languishing in judicial custody since 4.8.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kudra P.S. Case No. 293 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Kaimur at Bhabhua.
