2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 126 (2), 74, 75, 76, 352, 351 (2), (3), and 3 (5) of the BNS and Section 06 and 08 of the POCSO Act.

3. The case of the prosecution is that the petitioner allegedly attempted to outrage the modesty of the minor daughter of the informant. It is further alleged that when the family members of the informant came to rescue her, the petitioner allegedly bit her with his teeth and thereafter, fled away. Accordingly, the present FIR has been lodged.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that

No.67361 of 2025(2) dt.17-09-2025 2/2 from a bare perusal of the FIR, it is evident that the only allegation against the petitioner is that he allegedly attempted to outrage the modesty of the minor daughter of the informant. It is further submitted that the petitioner happens to be a neighbour of the informant and due to prevailing dispute between the parties, he has been falsely implicated in the present case. Moreover, the petitioner is languishing in judicial custody since 24.07.2025 and has no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Goradih P.S. Case No. 53 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court, POCSO cum District and Additional Sessions Judge -VII, Bhagalpur.
