The petitioner seeks bail in connection with Saraiya P.S. Case No.276 of 2019 registered under Section 394 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that on the basis of the written report of the informant, the present case was lodged against two unknown miscreants. In course of investigation, the confessional statement of the petitioner was recorded, while he was in custody in connection with Saraiya P.S. Case No.360 of 2019 by the police, showing his involvement in the present case also. Except the confessional statement of the petitioner, there is
Patna High Court CR. MISC. No.80158 of 2019(3) dt.09-01-2020 2/2 nothing against the petitioner to connect him in the present case. The petitioner is in custody since 10.07.2019. While the petitioner is accused in two other cases, as detailed in paragraph-3 to this application, but in those cases, he is on bail. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, West, Muzaffarpur, in connection with Saraiya P.S. Case No.276 of 2019. Out of the two sureties, one must be either parents or the close relative of the petitioner.
