JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This application, for grant of anticipatory bail, arises out of Kudhani (Turki O.P.) P.S. Case No.86 of 2019, disclosing offences under Section 394 of the Indian Penal Code. Allegation as per F.I.R. is that while the informant was returning to his house, four miscreants on two motorcycle came and snatched away Rs. Forty Eight thousand and mobile as well as other articles from the informant on the point of pistol.
Submission of learned counsel for the petitioner is that he is a student and has falsely been made accused in this case only because his motorcycle was recovered and further he has no criminal antecedent. Further submission is that the informant has also filed a petition before the court below that petitioner was not present at the place of occurrence.

Having heard both sides, considering the facts and circumstances , I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the basis of materials available in case diary, without being prejudiced by this order.
