2. The petitioner apprehends her arrest in connection with Nagra P.S. Case No. 59 of 2025, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, total 13 litres country made liquor was recovered from the bush in front of the house of petitioner.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to suspicion. No incriminating material has been recovered either from conscious possession of the petitioner or from her house or premises. Recovery of illicit liquor has been made from an open place which does not belong to the
Patna High Court CR. MISC. No.69723 of 2025(2) dt.14-10-2025 2/2 petitioner and the same is accessible to public at large. Petitioner has no concern with the seized liquor. Petitioner has no criminal antecedent. Petitioner undertakes to co-operate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the Petitioner, above-named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-cum-Presiding Officer, Exclusive Special Excise Court No. 3, Saran at Chapra in connection with Nagra P.S. Case No. 59 of 2025, subject to the conditions laid down in Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
