The petitioner seeks bail in connection with Khagaria P..S. Case No. 880 of 2017 registered under Sections 30(a) of Bihar Prohibition & Excise Act 2016 and Sections 272, 273 of the Indian Penal Code.

28.350 lts. of country made liquor is said to have been recovered from the bag of the petitioner and the petitioner was apprehended.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case planting the alleged recovery of the liquor from his possession. No

Patna High Court Cr.Misc. No.7362 of 2018(2) dt.13-02-2018 2/2 incriminating article has been recovered from his conscious physical possession. The petitioner has no criminal antecedent. The petitioner has been languishing in custody since 13.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Session Judge 1st, Khagaria in connection with Khagaria P..S. Case No. 880 of 2017.
