It is submitted by the petitioner's counsel that during pendency of the instant application, the petitioner has been granted bail under Section 167(2) Code of Criminal Procedure by the learned court below itself and, therefore, he seek permission to withdraw the application as the same has become infructuous. The permission is accorded.

The application is dismissed as withdrawn.

This Court would expect that the petitioner's counsel would honour his undertaking in the instant proceedings regarding supply of the requisite court fee etc. within two weeks from the date he is called upon to do so by the office.
