JUSTICE RAKESH KUMAR ORAL ORDER 29-11-2016 In view of earlier order report regarding status of the case has been received and kept at flag „C‟. The report suggests that in this case after framing of charge evidence has already commenced and till date at least one witness has been examined whereas the present petition was filed against order rejecting discharge petition in Sessions Trial No. 1021 of 2012 arising out of Bihta P.S. Case No. 200 of 2011 pending in the court of Additional Sessions Judge VII, Danapur. Since trial has already commenced the court is of the opinion that there is no reason to further keep the matter pending.
The petition stands disposed of even under the heading
Patna High Court Cr.Misc. No.42445 of 2013 (5) dt.29-11-2016 2/2 "For Order On Office Note" granting liberty to the petitioners to take all the pleas which were taken in the present petition before the court below at appropriate stage.
