Petitioner seeks bail in a case registered for the offences punishable under Sections 121, 121(a), 124(a), 427, 120(B), 307 of the Indian Penal Code, 1860 (IPC), Section 27 of Arms Act, 3/4 Explosive Substance Act, 3/4 Prevention of Damage to Public Properties Act, 1984, 16/17 Unlawful Activities Prevention Act, 17 of the Criminal Law Amendment Act, and 150,151,152 Railway Act, 1989. It appears that similarly situated some other co-accused has already been allowed bail by a Coordinate Bench of this Court vide Annexure-2. The petitioner was identified among the mob of Maoist. The mob had put some
Patna High Court Cr.Misc. No.7434 of 2018 (2) dt.08-02-2018 explosive to disrupt the movement of the train. The petitioner is in custody since 14.10.2017 and has got no criminal antecedent.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chakiya Police Station Case No.151 of 2014, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
