The petitioner seeks bail in Jehanabad Mahila P.S. Case No. 19 of 2017 registered under Sections 323, 376 and 511 of the Indian Penal Code.
Petitioner is said to have taken away the minor daughter of the informant from his house enticing her and tried to commit rape against her and also inflicted several bite injuries on her person.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. As a matter of fact, the informant had taken some money from the petitioner and on demand back his money, she has falsely implicated the
Patna High Court Cr.Misc. No.8444 of 2018 (4) dt.19-03-2018 2/2 petitioner in this case by inflicting injury on the person of the victim. The injury on the person of the victim is simple and superficial in nature. The brother of the victim was present in the house of the informant at the time of allegedly taking away the victim from the house by the petitioner, but he did not oppose it which creates serious doubt about the prosecution case. The petitioner has been languishing in custody since 06.04.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-I, Jehanabad in connection with Jehanabad Mahila P.S. Case No. 19 of 2017 / POCSO 30 of 2017. (Prakash Chandra Jaiswal, J) Mishra/- U T
