The petitioners are apprehending their arrest in connection with Mansi P.S.Case no.20 of 2018 , registered for offences punishable under Sections G.R.No.231 of 2018 of the Indian Penal Code.
Allegation against the petitioners is of assault to the informant and his family members and also setting the house on fire.
Submission of the learned counsel for the petitioners is that there is case and counter case between the parties and there is no allegation of setting the house on fire. Injuries are simple, one is
Patna High Court Cr.Misc. No.20157 of 2018 (2) dt.11-04-2018 2/3 on the hand and another injury on the head and the opinion on the injury has been kept reserved. From the petitioners side also the persons have received injury. Petitioner no.1 is the government servant.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above , let the petitioners, above named, surrender before the court below within a period of six weeks from the date of receipt of this order and on their surrender they will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria in connection with Mansi P.S.Case No.20 of 2018 dated 31.1.2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is disposed of.
