1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends her arrest in a case registered for the offence punishable under Sections 306, 504, 506 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a young girl aged about 19 years. It is next submitted that based on suspicion, she came to be implicated in the instant case by the informant who is brother of the deceased. It is further submitted that from perusal of the allegation as alleged in the F.I.R. it would manifest that the informant alleges that his brother had left the house at 4 in the evening on 26.06.2023 without

No.67874 of 2023(4) dt.13-03-2024 2/3 informing anyone that as to where he is going and when he did not reach home till late in the evening, then all the family members started searching him and during search they came to know that he had gone near the gate of the refinery. Accordingly, they reached the refinery where they came to know that his brother had gone there with Bittu Kumar, accordingly, they reached thee house of Bittu Kumar who informed that he left for Teghra and thereafter it is alleged that 7 in the morning the next day, the dead body of the deceased was found lying near a government school, where a bottle and tablet of Sulfas was also found. It is further alleged that the deceased was in love with Ritu Kumari (petitioner) and when the parents of Ritu Kumari came to know about the said love affair they threatened the deceased as such based on suspicion, it is alleged that the deceased might have come to meet the petitioner.

The learned counsel submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant is not an eyewitness to the occurrence and the entire allegations hinges around suspicion. It is not also the case of the prosecution that the petitioner was last seen in the company of the deceased, whether the petitioner was in love with the deceased or not is an aspect of investigation. No.67874 of 2023(4) dt.13-03-2024 3/3 submitted that petitioner is a young girl aged about 19 years, who is pursuing her teacher's training course from Fatima Teachers Training College, Kanke, Jharkhand for the sessions 2022-2024. It is next submitted that in the nature of allegation as alleged if the petitioner is sent to judicial custody her entire career would be jeopardized and chances are bright that she might come in contact with criminal minded women languishing in judicial custody.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Teghra P.S. Case No.200/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
