2. This petition has been filed for modification of order dated 26.09.2022, passed in Cr. Misc. No. 18934/2022 to the extent of extension of time period to pay the defalcated amount to Electricity Company as directed in the aforesaid order as well as period of surrender.

3. Learned counsel for the petitioner submits that due to reasons assigned in the modification petition, petitioner was unable to comply with the direction of Hon'ble Court vide order dated 26.09.2022 and could not refund the alleged amount of Rs. 4,60,000/- to the Electricity Company as such, he prays for further time to refund the aforesaid amount.

In view of the aforesaid contention made on behalf of the petitioner, further six weeks' time from today is granted to the petitioner to surrender and furnish bail-bond before the concerned Court where the case is pending, subject to deposit of Rs. 20,000/- (Rupees Twenty Thousand) in the office of concerned District Legal Services Authority and to furnish its receipt with the bail-bond with further condition to pay Rs. 4,60,000/- (Rs. Four Lacs Sixty Thousand) to the concerned Electricity department through bank draft within nine months from today, failing which learned court below would be at liberty to cancel the bail-bond.

5. The aforesaid amount of Rs. 20,000/- (Rupees Twenty Thousand) may be utilized by the Civil Court concerned in purchase of furniture and beautification of the court premises.

6. Accordingly, said order is modified to the extent indicated above.
