Petitioner, already in custody, seeks bail in connection with Kateya P.S. Case No.36 of 2017 (Trial No.2332 of 2018), registered under Section 392 of the Indian Penal Code. It is contended that the only material against the petitioner is his confessional statement and the criminal antecedent, except that there is no other material against him, neither any incriminating article was recovered nor he was put on TIP, moreover the petitioner has remained in custody for more than a year.
Having considered the aforesaid facts and circumstances, petitioner Golu Kumar Mishra @ Shubham Kumar Mishra @ Golu Mishra is directed to be released on bail
Patna High Court Cr.Misc. No.20002 of 2018(2) dt.05-04-2018 2/2 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XV, Gopalganj in connection with Kateya P.S. Case No.36 of 2017 (Trial No.2332 of 2018) with conditions that one of the bailors must be the close family member of the petitioner and the petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
