JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 12-01-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

It has been alleged by the informant that while he along with his son was coming to his village by motorcycle on 07.10.2017 at about 6.00 p.m. and as soon as reached near villagePanchrukha, his co-villagers Lal Bihari Mahto, Amerika Mahto, Rajbali Mahto and Tuntun Mahto followed him over motorcycle and forced him to stop and then thereafter, Lal Bihari Mahto gave Khukhri blow over his head while Amerika Mahto gave chhura blow causing injury over his neck, Rajbali Mahto encircled his neck with towel and pulled, as a result of which, he felt suffocation. His son Vishal was also attempted to be throttled. Then thereafter, they took away Rs.5,000/- cash and a chain. From

No.1505 of 2018 (02) dt.12-01-2018 the injury report, it is evident that though two injuries have been found over the person of informant, but simple in nature and for that petitioner is under custody since 26.11.2017. That being so, petitioner, Lal Bihari Mahto is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Turkauliya (Banjariya) P. S. Case No.654 of 2017.
