The petitioner is languishing in custody for the offences punishable under Sections 302/120B of the Indian Penal Code and Section 27 of the Arms Act.
The son of the informant was seen last along with the petitioner and others in the matter of some talk relating to Kanti P.S. Case No.142 of 2012. Subsequently, dead body of the son of the informant was noticed towards field-side whose murder was committed by causing fire-arm injury.
Submission is that there is no eyewitness of the occurrence. Only suspicion is there. The dead body was not recovered at the place where deceased was seen last along with
Patna High Court Cr.Misc. No.9944 of 2018 (3) dt.30-03-2018 P2/ named accused persons. Petitioner is in custody since 13.12.2017. Investigation of the case is already complete. Petitioner is ready to cooperate with the trial.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kanti P.S. Case No.363 of 2012, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
