2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 323, 498A of the Indian Penal Code and the petitioner is the husband.
3. Despite issuance of notice to opposite party no. 2, no one appears on her behalf.
4. The prosecution case is based upon a complaint filed by the opposite party no. 2 (complainant) in which she has made allegations of demand of dowry and torture upon the petitioner and his family members.
5. Learned counsel for the petitioner submits that the allegations made in the complaint are totally incorrect and as a
Patna High Court CR. MISC. No.71317 of 2024(5) dt.22-04-2025 2/2 matter of fact, the petitioner has never indulged in any demand of dowry or torture inflicted upon the complainant. Categoric statement has been made in para-14 of the petition that he is ready to keep the complainant with honour and dignity. It has been stated that it is the complainant herself who is not desirous of living with the petitioner and hence, has filed this false case against the petitioner and his family members.
6. Learned APP for the State has opposed the application for anticipatory bail.
7. In view of all the above-mentioned facts and circumstances, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint P.S. Case No. 280 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
