JUSTICE ARUN KUMAR ORAL ORDER 29-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 26.12.2017 seeks bail in connection with Tekari (Panchanpur) P.S.Case No. 510 of 2017 registered under Sections 399,402 and 414 of the Indian penal Code and 25(1-b)a, 26 and 35 of the Arms Act. Allegation in brief is that the police apprehended some miscreants said to have been making some plain for committing dacoity and recovered of arms from the possession of some of them.
Submission is that petitioner is a hawker and was moving after parking the motorcycle on the road and the police apprehended him, motorcycle was registered in the name of his brother and no incriminating article was recovered from his possession, besides this, he has clean antecedent.

No.17970 of 2018 (2) dt.29-03-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely, Shiv Shankar Rao, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Tekari (Panchanpur) P.S. Case No. 510 of 2017.
