The petitioner seeks bail in Khajauli P.S. Case No.161 of 2011, registered for the offences punishable under Sections 363, 364, 365 and 120(B) of the Indian Penal Code. As per the prosecution case, this petitioner who is one of the named accused in this case instituted on the basis of Complaint Case No.1358 of 2011 with allegation of torture and assault.

Learned counsel for the petitioner submits that the petitioner is brother-in-law of the deceased and no specific overt act has been alleged against the petitioner. Similarly situated coaccused, Pramod Das has been granted bail by a different coordinate Bench of this Court vide Cr. Misc. No.28861 of 2021

Patna High Court CR. MISC. No.67277 of 2019(4) dt.02-11-2021 2/2 on 12.08.2021. The petitioner is in custody since 06.07.2019 and he has got no criminal antecedent as stated in paragraph 3 of the bail petition. It is also submitted that the husband of the deceased has already been granted bail by the learned court below.

Learned Additional Public Prosecutor opposed the prayer for bail of the petitioner.

Having considered the facts aforesaid, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Madhubani in connection with Khajauli P.S. Case No.161 of 2011.
