The petitioner, who is in custody, seeks bail in connection with Sadar P.S. Case No. 597 of 2017 registered for the offence punishable under Sections 461 and 379 of the Indian Penal Code and later on Section 411 of IPC was added. Informant submitted a written report before the S.H.O. of Sadar P.S. in which he has stated that in the night of 05.11.2017 some unknown persons have stolen 148 bags of maize seeds after breaking the lock of the door of the godown. The informant received the informantion of this occurrence at 6:00 AM by the guard and other persons. The informant also

Learned counsel for the petitioner submitted that petitioner is not named in the FIR and he is quite innocent and has committed no offence as alleged in the FIR. It has been further submitted that during course of investigation the I.O. raided the house of Md. Mobinuddin where Tata pick-up van, 67 bags of maize seeds were recovered. The apprehended accused Md. Mobinuddin, Dharmvir Paswan and Md. Zibrile named this petitioner. It has been further submitted that coaccused persons, namely, Md. Kaisher, Md. Kadir and Md. Mobinuddin have been granted bail by a Coordinate Bench of this Hon'ble Court vide order dated 01.02.2018 passed in Criminal Miscellaneous No. 2758 of 2018, vide order dated 02.02.2018 passed in Criminal Miscellaneous No. 4976 and order dated 02.02.2018 passed in Criminal Miscellaneous No. 4027 of 2018 respectively. It has further been submitted that petitioner is in custody since 13.11.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of
