JUSTICE ARUN KUMAR ORAL ORDER 04-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 02.11.2017, seeks bail in connection with S.Kamal P.S.Case No. 337 of 2017 registered under Sections 25(1-b)a/26/35 of the Arms Act and 17 of the C.L.A. Act.
Allegation in brief is that 125 live cartridges were recovered from the house of the petitioner.
Learned counsel for the petitioner seeks bail on the ground of parity as another co-accused Manchan Yadav, from whose possession identical number of live cartridges were recovered, was admitted to bail by a co-ordinate Bench of this Court vide order dated 29.03.2018 passed in Cr. Misc. No. 17215 of 2015. Having considered the aforesaid facts and circumstances, the petitioner, namely, Arvind Kumar Das, is directed to be
Patna High Court Cr.Misc. No.19069 of 2018 (2) dt.04-04-2018 2/2 released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Begusarai in connection with S.T. No. 54 of 2018 arising out S.Kamal P.S. Case No. 337 of 2017, with condition that one of the bailor must be his close family member. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, his bail bond shall be liable to be cancelled.
