Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 379, 385, 307, 427, 504 of the Indian Penal Code and now Section 302 of the IPC will also be applicable.

The allegation of commission of assault to the deceased is against co-accused Sonu Patel. Learned counsel for the informant opposed the prayer for bail on the ground that during investigation, witnesses have stated that this petitioner had also assaulted to the deceased.

Since subsequent statement in the case diary contradicts the statement of the informant who is an eye witness of the occurrence, let the petitioner, above named, be

Patna High Court Cr.Misc. No.17752 of 2018 (2) dt.30-03-2018 released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sangrampur Police Station Case No.199 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
