Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 352, 351(2), 74, 75(1), 3(5) and 109 of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 28-6-2025 at about 6 am, she was repairing her stove, when the accused person including the petitioner came and petitioner started abusing her and also caught her hand with an ill intention and molested her and said that the land belongs to him, further the accused persons also damaged the stove and

Patna High Court CR. MISC. No.67798 of 2025(3) dt.15-11-2025 2/3 when her son came to rescue her, the petitioner assaulted him by an iron rod causing injury on head.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant on account of dispute relating to land. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that informant alleges that petitioner said that the land belongs to him, which amply demonstrates that petitioner and the side of the informant are having dispute relating to land. It is further submitted that on 28-6-2025, it was the side of the informant who had assaulted the petitioner for which Warisaliganj PS Case No. 339 of 2025 was instituted against the side of the informant and others, as such the instant FIR is a counter blast. It is also submitted that even presuming what has been alleged is true without admitting then the blow was not repeated and the injury has been opined to be simple in nature and petitioner is not a criminal.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court

Patna High Court CR. MISC. No.67798 of 2025(3) dt.15-11-2025 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Warisaliganj P.S. Case No. 341 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
