JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bisfi P.S. Case No. 245 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 16.5 litres of liquor from the Bhusa Ghar of the petitioner.

Submission of learned counsel for the petitioner is that it is an open place and petitioner has falsely been implicated who has no criminal antecedent.

Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner stating that recovery is made from the Bhusa Ghar of the petitioner.

In view of above facts and circumstances, this

No.62748 of 2019(2) dt.15-10-2019 2/2 application is disposed of with direction to the petitioner to surrender in the court below and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
