The petitioner has sought for recalling order dated 16.08.2022 by which CWJC No. 13122 of 2006 was dismissed for non-prosecution.

For the reasons stated in the application and affidavit of MJC No. 2344 of 2022 order dated 16.08.2022 is recalled while restoring CWJC No. 13122 of 2006, subject to payment of cost of Rs. 2000/- (Rupees Two Thousand Only). Cost shall be remitted in the Patna High Court Legal Services Committee within a period of four weeks' from today. Accordingly, restoration application stands allowed.

Patna High Court MJC No.2344 of 2022(3) dt.08-02-2023 2/2 Registry is hereby directed to list CWJC No. 13122 of 2006 before the roster bench.
