JUSTICE ARUN KUMAR ORAL ORDER 16-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Narhat (Sitamarhhi) P.S.Case No. 41 of 2017 registered under Sections 363 and 366A of the Indian penal Code. Submission is that its not a case of kidnapping rather elopement, both were in love relationship so eloped and got married and girl has stated this fact in her statement recorded under Section 164 Cr.P.C. She was not examined by the Medical Board but she has disclosed her age 19 years and the Magistrate has assessed her age 16 years.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Raju Kumar Ram, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the
