JUSTICE ARUN KUMAR ORAL ORDER 08-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Matiyariya PS Case No. 55 of 2017 registered under Sections 376 and 511 of the IPC.
Submission is that the petitioner has been implicated due to some dispute, both are co-villagers, the prosecutrix is a married lady, allegation is of making attempt of rape in day hours inside her house and there is no other witness.
Having considered the said facts and circumstances, the petitioner, namely, Ram Sharan Manjhi is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, Vth, West Champaran at Bettiah in connection with Matiyariya PS Case No. 55 of 2017.
