This writ application has been filed for setting aside order dated 03.09.2010 contained in Memo No. 452 (P) issued by the Director, Secondary Education by which the claim of the petitioner for approval of his service was rejected on the ground that the petitioner was appointed on the post of peon after 04.02.1989. The petitioner has further made a prayer for a direction to recognize his services as peon in Smt. Janki Devi Uchcha Vidyalaya, Madhopur (West Champaran).

However, after some argument, learned counsel for the petitioner requests for disposal of the writ petition with liberty to the petitioner to move before the respondent no. 3/ Director (Secondary Education), Department of Education, Bihar in the light of the judgment dated 14.09.2018 passed by this Court in C.W.J.C. No. 17248 of 2011.

4. In view of limited prayer made on behalf of petitioner, this writ petition is disposed of with liberty, as indicated above. In case, such representation is filed, the respondents shall examine the claim of petitioner in the light of aforesaid judgment of this Court dated 14.09.2018 in C.W.J.C. No. 17248 of 2011 and thereafter, pass a reasoned and speaking order in accordance with law.

5. With aforesaid direction, the writ petition stands disposed of.
